#DickheadDetox : Tim Lott's Ode to Domestic Violence in the Guardian

Posted on 13:25 by Unknown

As the lovely Glosswitch stated on twitter earlier this week, the Guardian have managed to find the only literate MRA and have given him a job. Like Glosswitch, I've only recently come across Lott The Arsewipe but he's like every other misogynistic fucknugget whinging about his penis and why women refuse to kowtow to it.

Lott belongs on the #DickheadDetox for a number of reasons starting with insulting his wife in the national press, whining about having to share "his income" with his wife, and reinforcing harmful gender stereotypes which are based on male control of women. What concerns me the most is the sheer number of red flags for domestic violence within his columns. Lott's construction of his relationship is one in which he has control; that is not normal and it is not healthy. It is disgraceful that the Guardian is giving space to a man who writes such twaddle.

For an excellent takedown of Lott's nincompoopery, do read Glosswitch's blog. I've reblogged a section below but the entire piece is a must read:

Using a central scene in the film as a springboard, Lott offers up a self-important analysis of what he calls the difference between “acceptance” (as displayed by him) and “resignation” (as displayed by his morally inferior wife). While acceptance is “a wholehearted, positive acceptance that no one can be everything you want them to be” (and “is hard”), resignation is “the refusal to take on board the fact that people are different from you and, anyway, you cannot cast the first stone unless you are without sin yourself”. While Lott generously allows that his wife might have “more to complain about than I do”, he argues that “one thing she doesn’t have to put up with — by and large — is me complaining about her”. Since he doesn’t add “except in the pages of a national newspaper” I’m assuming the irony of the whole character assassination has escaped him (and yes, I know I’m having a go at Tim myself, but then I’m not the one preaching bloody “acceptance” in the first place).
I’ve since learned that on all matters domestic, but especially those involving the humiliation of one’s nearest and dearest, Lott has form. Last week’s piece was called Money – the biggest taboo in a relationship, and in it, Lott discussed the apparent complexities of earning more than one’s wife when she happens to be doing more of the unpaid domestic labour. You and I might think “just share the bloody money” but apparently that’s “archaic” and Lott isn’t “quite sure what would be a better alternative”. Hence while he’s waiting for that alternative to appear, he keeps more money for himself and “if there’s a big expense, say a foreign holiday or house improvements, I tend to have the last say”. But don’t worry – it all balances out in the end:
My wife says that my having more money than her makes me feel powerful. She’s right – up to a point. It gives me an area of control, although I don’t think I use it in order to control. I just think some form of imbalance is inevitable. When it comes to the house and children, my wife enjoys virtually total authority.
The point that Lott seems to miss is that while his wife may have “authority” over the dirty socks, that’s because it’s become her job (in case you’re wondering, Lott shrunk a sweater in the wash once and is therefore incapable of helping). It’s the same type of “authority” Lott has over his writing. It’s not the same as the reward. It’s not the same as the fundamental freedoms that financial autonomy brings. I suspect deep down Lott knows this (how could he not?) but is playing dumb.
...
I imagine there are members of the men’s right’s “movement” who’d consider Lott too “Guardian” to really be one of them. They’d be wrong. He’s the perfect example of the way in which, via Essential Difference neurosexism, Fathers 4 Justice grandstanding and hype over male underachievement, the men’s rights narrative of resentment has become mainstream. It could be there at your own dinner table. Don’t listen to it. Achieving the right balance is difficult in any household but we can all do better than resignation, acceptance or whatever someone who claims to speak for you is telling you to call it.

#DickheadDetox : Asshole Lists "Flaws" He Likes in Women:

Posted on 02:24 by Unknown

Some tool, called Mark Manson, wrote a list of 7 "Flaw" he likes in women for Thought Catalogue. I am so bored of the constant articles, nearly always written by men, trying to extrapolate their personal sexual desires as the "norm". The self-indulgent, narcissistic approach to sexuality in our culture is abusive and exploitative. The idea that the orgasm of one person is more important than the safety and personal boundaries of the person they are fucking is disgusting.

I hate the privileging of male sexuality and I loathe the men who take advantage of this: like Mark Manson. Normally, I'd ignore this shite but Manson brings the "domestic violence as romance" theme to a whole new level: one where he "forgives" us our imperfections in his voyage of self-discovery [which seems to miss the whole he's an asshole bit].

The first paragraph is Manson explaining what every woman has known for a millenia as if its somehow a new and exciting theory:
I feel more and more that our culture is conditioning us to expect, no — demand a perfect romantic or sexual partner for ourselves. It’s easy to forget that finding someone you truly want to be with isn’t a matter finding someone who is perfect or flawless, but finding someone who you actually grow to love their flaws.
Clearly, Manson missed the whole medieval knights and chivalry bullshit poetry period. And, every self-help book written in the 19th and 20th century. Seriously, does he genuinely believe this is a new pet theory? I don't know if I should be laughing hysterically at this point or leaning my head on my desk and crying for our species.

Having psycho-analysed himself [and continued to miss the bit where he's an asshole], Manson dedicates the piece to "the girl of my dreams and her issues, her traumas, and her deepest flaws. And not just the faults that I can tolerate, but the faults that I can love." Well, isn't that just peachy-keen and lurvely. Just reading that makes me cream myself with excitement or vomit. One or the other. My poor ickle girlie brain just can't compute the level of romance in that statement.

I've reproduced all "The Flaws" below as they have to be read fully to be believed. All of them are disgraceful, woman-hating twaddle with a serious side of domestic violence. They are all huge red flags. Part of me is glad Manson wrote this so that potential partners can be aware of his violent personality at the start but the other part of me is angry that anyone would publish this bullshit.

The first two flaws are the most important to read, everything after that is Manson's Ode to His Penis. The first "flaw" is Manson clearly looking for a woman to emotionally and psychologically abuse. It is an obvious indicator of a man who is controlling. The second flaw is the same indicator with Manson looking for a woman to shoulder the responsibility for everything that goes wrong in Manson's life.

Manson belongs on the #DickheadDetox. He certainly doesn't deserve to ever have a relationship with a woman [or be a potential father to children].

The Flaws:

FLAW #1: She’s Slightly Neurotic - I’m an extremely laid-back guy. Some people may say too laid-back. But every girl I’ve developed a strong emotional connection with has told me that I have a calming effect on them. Girls who are slightly neurotic feel right to me for two reasons: for one, if there’s something I should be worrying about, but I’m not, they’ll always catch it. And secondly, when they’re worrying about something that’s unnecessary, I enjoy being able to help them relax and feel more secure about it. It’s a nice dynamic, as it makes me feel needed and they’re always appreciative.

FLAW #2: She Blames Herself Too Often - This one’s a little twisted, but I like it. It makes me feel more at ease. My biggest pet peeve in the world is people who do not take responsibility for their actions. So if a girl blames herself too often, then I never have to worry about her shirking responsibility for things going wrong. But the biggest reason is I don’t handle people blaming me or judging me well. Never have. When I feel like I’m being blamed unfairly, my tendency is to either shut down or to simply leave. Obviously, this is not a helpful tendency in a relationship. On the other hand, I’m an EXTREMELY non-judgmental person and rarely blame the person I’m with, so I’m unlikely to pile on the blame if she’s being hard on herself. On the contrary, as a recovered Nice Guy, I have a tendency to want to help my partner feel better about herself and let go of whatever is bothering her, so this gives me another opportunity to do that. Hey, I never said I didn’t have flaws either. But it seems women with this flaw complement my flaw really well and the relationship works.

FLAW #3: She’s A Work-A-Holic - I get bored easily. If I’m with a girl who doesn’t have a lot going on in her life, I get bored with her easily. I find ambition sexy. I run my own business and will often pull 14- or 16-hour workdays and I need her to understand and support that. Women who work their ass off for something just tend to be much more interesting.

FLAW #4: She’s A Risk-Taker - I need someone who thinks outside the box, who is open-minded and up for trying something crazy or stupid on a whim. My last serious girlfriend, the day we broke up, we decided to go skydiving together to commemorate it. Don’t ask me why, but it was awesome. I love taking risks and having adventures. I want a girl who if I say, “Hey, I just bought us plane tickets to Dubai tomorrow, let’s go!” she won’t hesitate to say yes. She won’t complain about work or worry about what her mother would think or whatever. She’d drop everything and go.

FLAW #5: She’s Vain - I realize this is entirely self-indulgent, but I love it when women take the time and effort to make themselves as beautiful as humanly possible. The 90 minutes in the bathroom before we go out to get dinner? I like that. I want her to look stunning. I then want to tell her that she looks stunning. I then want her to love it when I tell her that she looks stunning.

FLAW #6: She’s Pushy - Like I said earlier, I have a tendency to be too laid-back some times. And I also have a tendency to avoid commitment. As a result, some times I pull away from the person I’m seeing even if I really care about them and feel strongly about them. It’s an unconscious reaction and habit. So I need someone who won’t let me off the hook easily, because I know at some point I will try to get off the hook. Even though it annoys me at times, it’s good for the girl I’m dating to be pushy, the kind of girl who will call me three days in a row and bother me for not hanging out with her. I’ll hate it in the moment, I’ll complain that she’s needy and annoying and smothering me, blah, blah, blah — but I think in the long-run it works out better because if left to my own devices I’d let myself drift away and never come back.

FLAW #7: She Wears Her Heart On Her Sleeve - You know the stereotype of the concerned husband saying, “Honey, what’s wrong?” and she says, “Oh, nothing.” So he tries again, “No, really, what’s wrong?” and she still says “Nothing,” even though she’s obviously really pissed about something. Then eventually she blows up and acts as if he was supposed to magically know why she was pissed off the entire time and fix it. It’s a stereotype you see in movies and TV shows a lot. Yeah, I hate that. I can’t be with a girl like that. I think if that happened to me now, she’d be out the door. Anyone who reads this site knows that I’m obsessed with blunt, painful honesty. I always want to know what people are thinking and feeling and I want everyone to always know what I’m thinking and feeling. I love women who wear their hearts on their sleeve. I want them to have the opposite problem of not being able to hide their emotions even if they want to. This goes along with passion as well. Women who let their emotions just flow out of them tend to be incredibly passionate. I get weak in the knees for passionate women. It’s why I love Latin women and Eastern European women so much. Their emotions are so intense you think the world is going to crack in half some times. As a boy who came from an emotionally-stifled family in an English-speaking culture, I can’t get enough of it.

#DickheadDetox: Christian Jessen for Spreading Rape Myths.

Posted on 04:25 by Unknown

My personal loathing of reality TV star Dr. Christian Jessen is well-documented. I have no tolerance for men who think it is acceptable to define women's fuckability nor any medical professional who actually knows nothing about breast feeding who thinks it's "icky". Honestly, the man is nothing more than your average dickhead, except he also has a television show in which he gets to deliberately humiliate and denigrate people. Yay Capitalism.

This is what dear ole' Christian tweeted out today (read from bottom up as blogger is being silly about formatting)

  1. Dr Christian JessenDr Christian Jessen ‏@DoctorChristian36m
    2) female rape is abhorrent but much male rape goes on in prisons and is shrugged off as 'that's just what happens' -equally abhorrent!

    1) False accusations of rape are thankfully rare but very damaging to all. It's interesting how much bias there is in talking about rape...

interesting stat to follow my last tweets: men are statistically more likely to be victims of rape than to be falsely accused of rape.

    2) Why do women do this?! 2 many rape cases ignored, which is terrible, so why try this sort of damaging nonsense on to make it worse? Loons

  5. Dr Christian JessenDr Christian Jessen ‏@DoctorChristian1h
1)Terrible story of cabby accused of rape by female passenger only 2b saved by his recording of journey where nothing of the sort happened.

Well, isn't that some lovely "women are all liars" twaddle for a Friday morning.

When are men who insist on pontificating about rape actually going to bother reading some research into false rape accusations. Or, you know, actually engage their brain and think.

Dr. Christian is a misogynist. He won't bother listening to those pointing out that he is wrong. That is too much like making him take responsibility for his actions.

He is on the #dickheaddetox

UPDATE:

This was Dr. Christian's response to criticism:

#DickheadDetox: Aaron Carter's #tipsforgirls

Posted on 09:12 by Unknown

Aaron Carter, the Dude internationally reknown as the little brother of some other dude from some boyband from way back when, has taken to twitter to reveal his dating #tipsforgirls.

Bless his cotton socks, these are the pearls of wisdom from The Younger Brother of What's His Pickle:
Aaron Carter ‏@AARONCARTER16h Confident woman are sexy to any man. Don't pretend to be someone your not just to please a man. #TipsForGirls
Aaron Carter ‏@AARONCARTER17h Be Approachable- men don't like rejection- a woman with an attitude to her look will scare a man away. #tipsforgirls
Aaron Carter ‏@AARONCARTER17h A woman's appearance is a weapon to attracting a man- always look your best ( neatness, clothes,hair ,makeup,scent,etc... #tipsforgirls
I can not think Aaron enough for bringing these pearls to our attention, sometimes I actually forget that we live in a culture where women's value is based entirely on their ability to pass the Patriarchal Fuckability Test. I forget that women's intelligence and love is completely irrelevant unless they are white, blonde,  and thin. I forget that women have to ensure that their behaviour and appearance are pleasing at all times. God forbid, we hurt men's feelings but not actually wanting to fuck them.

We must always be approachable; even when we don't want to be approached because men's feelings are more important than women's safety and bodily autonomy.

Some genius has suggested that Aaron write a book about his #tipsforgirls. No one try to dissuade him from this policy; just imagine the hilarity it would cause on twitter.

#DickheadDetox : Micheal Fassbender

Posted on 08:45 by Unknown

Michael Fassbender is yet another male celebrity with a (possible) history of domestic violence which is rarely mentioned. At least, TMZ reported that his ex-girlfriend took out a restraining order on him in 2010 alleging a serious assault which involved breaking her nose with a chair. There were several other violent episodes listed in the restraining order. The petitioner withdrew in April 2010 and this is all the evidence I have as to whether or not Fassbender committed domestic violence. The balance of probabilities is that he did.

Withdrawal of allegations is common in cases of domestic violence. This is what makes keeping the #dickheaddetox accurate difficult. So few men are actually convicted of domestic violence that I do think it's important to keep a list of those who are accused of domestic violence. Statistically speaking, its probably true.

(Thank you to @pinkillusions for bringing the Michael Fassbender case to our attention)

#DickHeadDetox : Tom Sizemore's History of Domestic Violence

Posted on 11:19 by Unknown

Tom Sizemore has a long history of domestic violence and substance misuse. Below is a select list of some of his arrests and convictions for domestic violence and drug misuse.

2010: Arrested for domestic violence
2009: Arrested for an outstanding narcotics warrant
: Sued for outstanding child support owed for twin sons born in 2005
2007: Jailed for violating his probation in a drug case
2004: Sued for sexual harassment
Drug conviction and numerous stints in rehab
2003: Found guilty of domestic violence, criminal threats, vandalism and
making obscene and harassing phone calls against then partner Heidi
Fleiss. He was sentenced to 6 months in prison, rehab and anger
         management classes.
2002: Arrested for alleged battery

When will male violence and its relationship to drug abuse start being taken seriously? Substance misuse is frequently involved in violence against women and, yet, it is always the substance misuse which is considered most important. Prison may not be the best place for those with substance misuse problems but when it comes down to one violent man versus the safety of women, I'm always going to be on the side of prison despite believing that prison is not the best solution to the problem.

Until we start taking male violence seriously, I am always going to put the safety of women and children first. A radical reform of the entire judicial system is necessary, as is a complete restructuring of prisons. After all, Sizemore only received 6 months in jail for his serious assault on then-partner Heidi Fleiss and the subsequent harassment and stalking. Perhaps if that had been taken seriously, then his years of substance misuse and VAW would not have happened.

#Dickhead Detox: Jonathon Togo

Posted on 00:49 by Unknown

Jonathon Togo, an actor best known for his appearance on CSI: Miami was arrested in December 2009 for domestic violence. As ever, media coverage extends mostly to his arrest with the usual minimisation of his behaviour. Togo was booked and released with $50 000 US in bail provided but I haven't discovered whether or not he was convicted or if it was pled down to a misdemeanour. I'm assuming he wasn't convicted though. And, even if he was, it's not done his career any harm.

Another violent man.

Another name in the #DickheadDetox

#DickheadDetox : Lane Garrison and that Small Issue of Domestic Violence

Posted on 11:41 by Unknown

Lane Garrison is another actor I've never heard of until I read he wasn't going to prison for domestic violence despite being on probation for vehicular manslaughter when he assaulted his girlfriend. Since when is physical assault not an automatic violation of probation? Not to mention the measly fact that he assaulted a woman which is supposedly a crime in and of itself.

The poor wee poppet is not going to jail for domestic violence for his assault on his former partner Ashley Mattingly. Instead, Garrison has been required to attend 52 Alcoholics Anonymous meetings, 52 domestic violence classes, given 36 months of unsupervised probation, a restraining order and ordered to complete EIGHT hours of community service. All because he plead guilty. Ignoring the fact that domestic violence classes frequently aren't worth the paper they're suggested on, what the hell kind of punishment is eight hours of community service? 8000 hours maybe but not eight.

If this were Garrison's first offense, I might be willing to concede this was an appropriate punishment but it wasn't. In December 2006, Garrison pled guilty to vehicular manslaughter, drunk driving and providing alcohol to a minor. Garrison was partying with high school kids and tested positive for cocaine when he killed 17 year old Vahagn Setian  in the crash and injured two 15 year old girls.

Garrison is just another violent man with a history of alcohol and drug abuse for the #DickheadDetox

(And, erm, WTF was he doing partying with teenage girls? Could we at least pretend that is creepy too?)

#DickheadDetox: When did John Lennon become a feminist?

Posted on 10:08 by Unknown

Because I'm really, really struggling to understand how John Lennon, a man with a history of domestic violence against both his ex-wife and his son, constitutes a feminist. Actually, I'm a little perplexed about some of the other "feminist" men Marlo Thomas has included in her Huffington Post article, but, seriously, are there so few male feminist allies out there that we have to include a violent man? Is Thomas genuinely including Lennon for noticing that women constitute 50% of the population of the planet?

Because, I have to say, it doesn't really take a whole lot of intelligence to notice that women make up 50% of the population of the planet.

And, personally, my criteria for male feminist allies is pretty basic: don't commit violence against women and I will include you as an ally.

To be fair, though, I don't think the feminist movement needs men to be successful. After all, the true feminist allies don't need articles in the Huffington Post lauding them for noticing that half of the population in possession of a vagina. Those men who are true feminist allies are the ones who already listening, reading and asking good questions. We don't need to pander to them to get them involved because they are already here.

#DickheadDetox : David Bowie, Jimmy Page and that Small Issue of Child Rape

Posted on 07:07 by Unknown

I won't be buying David Bowie's new album today. I've been a fan for years. Right up until I read this blog post on the 70s rock scene in LA and the obsession with "Baby Groupies" in. I genuinely did not realise this was a thing until I read the blog last year: what kind of man has "sex" with a 13 year old child?

Apparently, a whole lot including Bowie but also :

  • Iggy Pop
  • Johnny Thunders of the New York Dolls
  • Jimmy Page
  • Mick Jagger
  • Dee Ramone
  • Marc Bolan
  • Alice Cooper
  • Rod Stewart
  • Bill Wyman
The child David Bowie raped, because no 13 year old can consent to sex with an adult man, was part of the "Baby Groupie" scene. I'm not going to name her here despite her name being easily available on line because I believe that all rape victims deserve anonymity. The young girl was then abused by Jimmy Page for more than a year and half. Their relationship started when his manager "kidnapped" her for Page. The young woman was repeatedly locked in hotel rooms by Page and his manager because of her age and their fear of the legalities of the situation; you know that whole child rape thing.

The media sources I have read about these two men claim that the 13 year old "lost her virginity" to Bowie and was in a consensual loving relationship with Page. She was a child abused by two adult men who have never really taken responsibility for their behaviour.

Bowie and Page may be brilliant musicians but they deserve to be on the #DickheadDetox.

I won't be buying their music ever again.

#DickHeadDetox : Ray Winstone's an Arsenugget

Posted on 13:44 by Unknown

So, Ray Winstone is an arsenugget, which is unfortunate because I rather enjoyed the new Sweeney film. But, I won't be helping financially support the careers of "celebrities" who are too stupid to understand the criminal definition of the word rape and the legal requirement to pay tax within a democracy in order to pay for all that is required to run the country: those pesky schools, hospitals, roads, parks, museums and whatnot. I mean, really, who the fuck wants those?

Apparently, dear sweet Ray believes that Britain is "being raped" by the requirement to pay high taxes.

He can just fuck off.

This is the legal definition of rape in England and Wales. The information below is taken directly from the Rape Crisis England/ Wales website. Dear old Ray may want to familiarise himself with it:
What is the current definition of rape in law?
The Sexual Offences Act 2003 (the Act) came into force on the 1 May 2004. It repealed almost all of the existing statute law in relation to sexual offences. The purpose of the Act is to strengthen and modernise the law on sexual offences, whilst improving preventative measures and the protection of individuals from sexual offenders.
Under section 1(1) SOA 2003 a defendant, A, is guilty of rape if:
_ A intentionally penetrates the vagina, anus or mouth of B (the complainant) with his penis;
_ B does not consent to the penetration; and,
_ A does not reasonably believe that B consents.
The new offence of rape in section 1(1) SOA 2003 includes oral and anal penetration with a penis. This is a change from the previous law which was only concerned with vaginal penetration and used other offences to criminalise these forms of sexual violence (such as indecent assault). The person who commits the offence of rape must be a man (as the penetration has to be with a penis).  However, both women and men may experience rape. If the penetration is with something other than a penis then the offence is assault by penetration
For the offence of rape to have been committed the defendant must have penetrated you without your consent, or continued to penetrate you after you withdrew your consent, and the defendant must not have reasonably believed that you were consenting.
It is not relevant what relationship, if any, a defendant has or had with you. Nor is it relevant if the act complained of occurred within a relationship. If the defendant intentionally penetrates with his penis the vagina, anus or mouth of the complainant without her consent where he does not reasonably believe in her consent the defendant has committed rape.
N.B. The wording regarding the law on our website uses the terminology that is commonly used in Law and legal proceedings. The offence of Rape (Sec 1(1) SOA 2003) can only be committed by a man; however, a woman can be charged with, or convicted of rape as a secondary party. For example, a woman may be convicted of rape where she facilitated (helped) a man who has raped another person.
The main provisions of the Act include the following:
  • Rape is widened to include oral penetration
  • Significant changes to the issue of consent and the abolition of the Morgan defence
  • Specific offences relating to children under 13, 16 and 18
  • Offences to protect vulnerable persons with a mental disorder
  • Other miscellaneous offences
  • Strengthening the notification requirements and providing new civil preventative orders
What is the definition of consent?
The Act has three important provisions relating to consent. They are:
  • A statutory definition of consent
  • The test of reasonable belief in consent
  • The evidential and conclusive presumptions about consent and the defendant's belief in consent
Section 74 defines consent as "if she agrees by choice, and has the freedom and capacity to make that choice" . In the offences of rape, assault by penetration, sexual assault and causing a person to engage in sexual activity without consent, a person (A) is guilty of an offence if (s)he:
  • Acts intentionally;
  • (B) does not consent to the act; and
  • does not reasonably believe that B consents.
Deciding whether a belief is reasonable is to be determined having regard to all the circumstances, including any steps A has taken to ascertain whether B consents (subsection (2) of sections 1-4). It is likely that this will include a defendant's attributes, such as disability or extreme youth. This is a major change in the law and the Act abolishes the Morgan defence of a genuine though unreasonably mistaken belief as to the consent of the complainant. It means that the defendant (A) has the responsibility to ensure that (B) consents to the sexual activity at the time in question. It will be important for the police to ask the offender in interview what steps he took to satisfy him that the complainant consented.
What involvement does the rape crisis movement have in law reform?
Rape Crisis was a participant on the external reference group of the Sex Offences Review. The rape crisis movement has also been involved in consultation with the Sentencing Advisory Panel, the Community Justice National Training Organisation, the Women's Unit, the Crime Reduction Programme and HM Crown Prosecution Inspectorate.
Should accused men be granted anonymity?
We must have anonymity for the victims otherwise women will not come forward to report. Most of the women who contact rape crisis have never reported to the police. We must respect the courage for those who do. It is not easy or pleasant going through all the police interviews and the courts. We must at least retain anonymity.
We must not treat the accused in rape cases any different from murder or child abuse. You cannot have special rules for the accused in rape cases as this will feed the myth that women who report rape are lying, that it is easy to report rape etc.
Anyone accused of rape should not be named until charged with the offence. Sometimes police forces do not adhere to this. On being charged it can be useful for the name of an accused to be published, as other women who have been raped by him, often with the same modus operandi, may be encouraged to report.
The Sexual Offences (Amendment) Act 1976 sections 4 and 5 provide for the anonymity of complainants in rape cases. The Criminal Justice Act 1988 amended the law on anonymity for complainants in rape cases so that anonymity commences when an allegation of rape is made to police and not--as provided in the Sexual Offences (Amendment) Act 1976--when a defendant is formally accused. The 1988 Act also removed the anonymity of defendants in rape cases. There were further additions made in the Sexual Offences (Amendment) Act 1992 and the Youth Justice and Criminal Evidence Act 1999.
What is the maximum sentence? The maximum sentence for rape is life imprisonment.
What is the average sentence? This varies widely. The average sentence seems to be around four years although we do know of many cases where this was much less.
Is prison the best solution? There are problems with prison. The man may simply gain access to a wider social circle in which he can find legitimacy for his actions. Sex offender treatment programmes have yet to be fully researched and are generally more geared towards child abusers than abusers of adult women. While prison remains the only way to secure women's protection we will continue to push for more appropriate sentencing. Of course for many women and children the abuse happens in secret, in the home and the man pays no penalty.
Should there be different offences of rape? No. This was agreed at the Sex Offences Review and there will be no recommendation for separate offences. Rape is rape regardless of the relationship or the context.
What are the common defences to rape?
There are 3 defences to rape:
  • Nothing happened
  • It wasn't me
  • She consented
Because of DNA fingerprinting, we are getting much fewer of the first two defences and much more of defence three.
Because of the Morgan ruling in the mid 1970s, to convict a man of rape first of all, the prosecution had to convince the jury beyond reasonable doubt that the woman was not consenting. Whether he was guilty or not depended on whether or not he thought she was consenting - what was going on in his head - not what was happening to her body. This was the "Morgan" rule which says that a man is not guilty of rape if he believed she was consenting NO MATTER HOW UNREASONABLE THAT BELIEF.
The Sexual Offences Act 2003 introduced the concept of 'reasonable steps'. Deciding whether a belief is reasonable is done by considering any steps he has taken to ascertain whether she consented (subsection (2) of sections 1-4).
This is a major change in the law and the Act abolishes the Morgan defence of a genuine though unreasonably mistaken belief as to consent.

Also, who knew that anyone was still employing noted talentless misogynists Danny Dyer?
